2.3 Access

Access to Pera Services requires the necessary equipment (e.g., smartphone, tablet, computer) and an active Internet connection. Direct access to Pera Services can be achieved through the Pera Site.

3Digital Currency Services

3.1 General Overview

Your Digital Currency Wallet empowers you to initiate Digital Currency Transactions by instructing the Pera Site to send Digital Currency to, or receive and store it from, third parties.

3.2 Handling Digital Currency Transactions

We will execute Digital Currency Transactions based on the instructions you provide. It is crucial to verify all transaction information before submitting instructions. We cannot guarantee the identity of any user, receiver, requestee, or other party.

Critical: Once broadcasted to the relevant Digital Currency network, a Digital Currency Transaction cannot be reversed.

We may impose network fees (miner fees) to process Digital Currency Transactions on your behalf. Note that most transaction fees are deducted from your BNB balance, so ensure sufficient funds for crypto transactions.

3.3 Supported Digital Currencies

Our Digital Currency Services are only available for digital currencies supported by Pera, subject to change. Do not attempt to use your Digital Currency Wallet for unsupported digital currencies.

3.4 Third Party Payments

We do not accept third-party payments via bank transfer or card payment. We have no control or liability for the goods or services purchased or sold to or from third parties using Pera Digital Currency Services. Disputes should be resolved directly with the involved third party.

3.5 Advanced Protocols

Unless officially announced, we do not support Advanced Protocols. Do not use your Pera Account for transactions involving unsupported Advanced Protocols.

3.6 Digital Currency Protocol Operation

We do not own or control the underlying software protocols governing supported Digital Currencies. These protocols are generally open source, and we assume no responsibility for their operation, security, or availability. You acknowledge the risk that software protocols may change, especially due to sudden rule changes ("forks").

4Transaction Limits and Enhanced Due Diligence

4.1 Transaction Limits

Your use of all Pera Services is bound by limits on the transaction volume, specified in your local currency, that you can conduct or transfer within a specific period. Your transaction limits may vary based on the verification steps you have completed and other relevant factors. We retain the right to modify these limits as we see fit.

4.2 Enhanced Due Diligence

We may request additional information about you or your business, ask for records, and arrange meetings with Pera staff. While we reserve the right to charge you for costs and fees associated with Enhanced Due Diligence, we will notify you in advance if we intend to do so.

5Suspension, Termination, and Cancellation

We retain the right to reject, block, cancel, or reverse any transaction you have authorized, or to suspend, restrict, or terminate your access to some or all of the Pera Services for various reasons, including:

In the event of refusing a transaction, suspending or closing your Account, we will, unless prohibited by law, provide notice of our actions along with the reasons for refusal, suspension, or closure.

Upon termination of this Agreement, unless prohibited by applicable law or court orders, you may transfer Digital Currency for ninety (90) days thereafter.

6Liability

6.1 Release of Pera

In the event of a dispute with one or more users of the Pera Services, you acknowledge that neither we nor our affiliates, service providers, officers, directors, agents, joint venturers, employees, and representatives will be held responsible for any claims, demands, or damages arising from or connected to such disputes.

6.2 Indemnification

You agree to indemnify us, our affiliates, and service providers, as well as each of our respective officers, directors, agents, employees, and representatives, for reasonable costs, including attorneys' fees and any fines, fees, or penalties imposed by regulatory authorities.

6.3 Limitations of Liability

Liability Cap: Our liability to you is limited to the combined value of Digital Currency in your Digital Currency Wallet at any given time. For specific claims related to a transaction, this sum is further restricted to the amount of the disputed transaction.

Limitation of Loss: We shall not be liable for loss of profits, reputation, business, or data.

Applicable Law: The liability limitations are subject to our obligations under applicable law, and they do not restrict our liability for fraud, fraudulent misrepresentation, gross negligence, deliberate misconduct, or injury resulting from negligence.
